Special Considerations:

No Excuse Bonus:
The No Excuse Bonus concept is to provide the contractor with substantial incentive to complete a project within a specified time frame regardless of any problems or unforeseen conditions that may arise.

Bonus #1: $1,750,000 Complete all contract work and obtain acceptance in 848 days.
Bonus #2: $150,000 Complete all the work to restore traffic to the SB Entrance Ramp (Ramp I) and NB on Ramp (Ramp J) to the final configuration with no additional lane closures within 30 days from closure.
Bonus #3: $150,000 Complete all the work to restore traffic to the NB Entrance Ramp (Ramp K) and SB on Ramp (Ramp L) to the final configuration with no additional lane closures within 30 days from closure.

Other Special Provisions:
Article 7-11.1.1: Routine Clean up: Contract requires the contractor to perform roadside mowing, litter removal large machine, small machine mowing, and edging around all appurtenances within the project limits at a cycle of 30 calendar days. In addition, it requires for mechanized sweeping on a maximum cycle of 14 days. Engineers upon 12 hours notice, could proceed with the clean up and will deduct those monies due to the contractor under this contract.

Article 7-11.3.1: Hauling and staging: Prohibits the contractor to stage and/or haul material and equipment using local surface streets.  Access to the project’s work zone shall be directly from I-95.

Article 8-3.3: Prosecution of Work- Flexible Start Time: Allows the contractor to procure material. It requires the contractor to obtain an approved schedule. Trainee requirements are identified and a trainee schedule is submitted and approved by the Department. Submittal of all critical shop drawings and attend a mandatory constructability workshop.

Article 8-3.7: Disputes Review Board: The Board will provide special expertise to assist in and facilitate the timely and equitable resolution of disputes, claims, and controversies between the Department and the Contractor in an effort to avoid construction delay and future claims.

Article 8.4-10: Protection of Adjacent Properties: Any equipment used by the Contractor for this project shall not exceed vibration levels of 5 mm per second at any point within 125 m of the right of way. The Contractor shall employ a qualified Specialty Engineer to monitor and record vibration levels produced by vibratory construction equipment used on this project.  The Contractor shall perform a Pre-Construction survey with the use of video and still photography on each property, located within 125 m from the Right of Way, identifying the existing structural conditions, of the property or any other improvement of such property which may be affected by vibration.

Article 8-4.11: Noise Restrictions: Contractor’s working hours generating noise above 50dba are restricted as follows: M-F 8:00 AM- 7:00 PM, Saturday 10:00 AM - 8:00 PM and no work is allowed on Sundays.
